Bidder and Auctioneer agree that the terms listed below shall govern this online real estate auction sale.

BIDDER VERIFICATION “PLEASE NOTE”: The identity of all bidders will be verified, bidding rights are provisional and if complete verification is not possible, Atkinson Realty and Auction will reject the registration, and bidding activity will be terminated.

AUCTION BID DEFAULT: In the event a winning bidder fails to submit the signed “Vacant Land As Is Contract for Sale and Purchase” and 10% good faith deposit of the contract price down as pre-stipulated in the auction terms, the winning bidder will be charged an administrative fee of $1,000.00 on the credit card provided when registering for the auction. Additional default remedies are reserved by Atkinson Realty and Auction, Inc. and the Seller as provided in the Auction Terms & Conditions and the “Vacant Land As Is Contract for Sale and Purchase.

All registration information the Bidder provides to Auctioneer shall be current, complete, and accurate. Bidders must be 18 years of age or older. Bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of or any transaction being conducted on and during the auction sale.

Terms and Conditions :
1) Auction Procedures - ONLINE BIDDING: Auctioneer reserves the right to reject the bidding of any person whose conduct, actions or adverse comments he feels are not in the best interest of his client, the Seller.

2) Inspection - The property is being sold “As Is”, “Where Is”. Buyer shall rely entirely on their own information and inspection. All dimensions, figures and drawings are approximate and should be independently verified prior to bidding. All information was obtained from sources deemed reliable but is not guaranteed. All improvements are selling “As Is”, “Where Is”.
3) Regulations and Restrictions - This property is selling subject to any existing rights of way, easements, encroachments, zoning regulations, government agencies regulation, restrictions and association rules, if applicable.
4) Contract Price - High bid plus 10% buyer’s premium.

5) Deposit - Payable to South Bay Title Insurance in the amount of 10% of the contract price in bank certified check or electronic bank wire transfer is due within 24 hours after close of the auction. These funds will be placed in the non interest bearing escrow account of, South Bay Title Insurance. 813-633-3330 if the highest bidder fails to perform, then such earnest money shall be non-refundable. Purchaser shall be responsible for all wire transfer fees.
6) Winning Bidder - After becoming the winning bidder you will be emailed AN AS IS CONTRACT for SALE AND PURCHASE TO BE EXECUTED WITHIN 48 HOURS AFTER CLOSE OF AUCTION. Location for executing the contract will be at the office of South Bay Title Insurance. 936 Cypress Village Blvd, Sun City Center, FL 33573 unless other arrangements are made.

7) Broker Participation - Cooperating brokerage is encouraged with licensed real estate brokers. A commission of 2% (two percent) will be paid to a broker that successfully registers the purchaser who closes on the property. The broker must register his purchaser prior to the day of the auction. Broker must send registration to Atkinson Realty & Auction, Physical Location 6003 28th St. E.

Brokers acting as principals are prohibited from this commission. There will be no exceptions. Late broker registrations will not be accepted at the auction site.
8) Financing - The sale of this property is not contingent upon the buyer’s ability to secure financing.
9) Closing - To be held on or before Thirty (30) days from execution of contract.
10) Conveyance - Property will be conveyed by General Warranty Deed, free and clear of all liens. If the property cannot transfer to you by virtue of bad title, your deposit will be refunded. You have no further obligation at that point and neither does the seller or the auction company.
11) Closing Costs:
Buyer to pay all closing costs.
Including all current and Back Taxes if any
Buyer is responsible for all costs related to a mortgage and survey

12) Possession - To be granted at closing on or before 30 days.
13) Final Authority - All decisions of the auctioneer shall be final concerning disputes among bidders or any other matters that may arise during the sale.

17) Buyer’s Remedy upon Seller’s Default - Should Seller default under the terms of the contract, Buyer’s sole remedy shall be the return of its earnest money deposit.
18) Seller’s Remedy Upon Buyer’s Default - Should Buyer default under the terms of the contract, Buyer’s earnest money deposit shall be forfeited unto Seller as Seller’s sole remedy.

20) Disputes Between Bidders: The final highest purchaser shall be designated at the end of each auction sale / item. If a dispute arises between two or more Bidders, Auctioneer reserves the right to reopen bidding. Auctioneers designation of the Buyer shall be final.

Injury, Damage and Indemnification: - Bidder acknowledges responsibility for any personal injury or property damage caused by Bidder or his agent, and further agrees to indemnify, defend and hold Auctioneer and Seller(s)harmless for any personal injury to himself or his agents, any property damage incurred on the sale premises, any and all claims, losses, damages, liabilities, judgments, fees and expenses related thereto, in connection with any claims arising out of, based upon, or resulting from any breach or violation by Bidder of this Contract or any use by Bidder of the auction sale or as a result of a dispute with another Bidder.

21a). AGENCY: Auctioneer is acting as agent for the Seller/Owner only and is not responsible for statements made by other parties.

22) Providing False Information and or not honoring your bid: You will be suspended or permanently banned from our site if you provide false information when registering, such as a false name or fraudulent contact information.
You will be permanently banned from our site if you are the successful buyer and you do not honor your auction bid.

23) HOLD HARMLESS: We cannot, and will not, be held responsible for any interruption in service, errors, and/or omissions, caused by any means, therefore we cannot guarantee continual, uninterrupted or error free service as our website could be interfered with by means out of our control.

Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.

The Auctioneer may void any sale, temporarily suspend bidding and re-sell any items that were affected by any malfunction.
The decision of the Auctioneer is final.
